MyEyeSite Patient Beta Terms & Conditions

MYEYESITE BETA WEBSITE TERMS OF USE

Thank you for agreeing to trial the beta MyEyeSite website, myeyesite.app (the "Beta Website"). The Beta Website is part of a collaboration project between us, Loft Digital Limited, Moorfields Eye Hospital NHS Foundation Trust and University College London. At present, the Beta Website allows you to upload and digitally store and review your eye health care records online and to share this data with certain, selected Moorfields Eye Hospital eye care clinicians who may add comments on your records (together, the current "Functionality").

Please read these Terms carefully as they set out the terms for your use of the Beta Website. When you email us to confirmation that you accept these Terms and/or when registering for an account you click to confirm you accept these Terms, you confirm that you agree to be legally bound by them. If you do not agree to any of the Terms, please do not use the Beta Website.

These Terms of Use only deal with your use of the Beta Website. Your dealings with, including any advice given to you, by any eye care clinician will be governed by the terms (including those implied by law) in place between you and the eye care clinician.

Terms of Use

  1. We are Loft Digital Limited, a limited company registered in England and Wales with company no. 06273936 and registered office Penrose House, 67 Hightown, Banbury, Oxfordshire OX16 9BE. If you have any questions on these Terms, the Beta Website or you wish to make a complaint you can contact us by email at enquiries@loftdigital.com.

  2. You acknowledge you will not receive any payment for any feedback you may give on the Beta Website. However, your use of the Beta Website is free, voluntary and you are free to stop using it and cancel your account at any time. If you do so, you will no longer be able to access your account or the information contained in it.

  3. Any feedback you give on the Beta Website may be used by us to make improvements to or to market the Beta Website or to create, update, improve or market any of our other websites, applications, software products or services. We may also share your feedback and our learnings from your feedback with others. When we use your feedback for any form of marketing or we share your feedback with others, we will only use/share your feedback in a way that does not identify you individually unless we have your permission to identify you. 

  4. You must register an account with us to use the Beta Website. To do so you must be at least 18 years old and located in the United Kingdom. Your account must be for your sole behalf only. You must not create an account on behalf of anyone else, including on behalf of any of your children.

  5. We reserve the right to, at our sole discretion, refuse any registration for an account.

  6. You must ensure that your account username and password are secure and confidential and must not disclose these to any other person. You are solely responsible for any activity on your account and for controlling access to and use of your account. 

  7. We may make changes to the Beta Website from time to time to improve it or to add new functionality.

  8. We may change these Terms from time to time, so you should check back regularly to see if anything has changed. We will also notify you of any significant changes to the Terms when you next log into your account on the Beta Website.

  9. The Beta Website is a beta version and you must not rely on it. We cannot guarantee the Beta Website will meet your requirements, be available at all times, operate properly or that data or content uploaded by you to the Beta Website will not be lost or damaged. Please ensure you keep all eye care health records separately to the Beta Website so these are not lost and it is possible to re-upload them.

  10. You must not:

    1. use the Beta Website in violation of any law; 

    2. upload or submit to the Beta Website any content or data or use it to send any communication which is not related to your eye health or which is false, fraudulent, obscene, pornographic, offensive, defamatory, threatening or which contains information concerning someone's political opinion, trade union membership, sexual orientation or religious beliefs) or which infringes the rights of any third party; 

    3. use the Beta Website in any way which may impair the Beta Website, including not transmitting or inputting any malicious software or viruses; or

    4. attempt to reverse engineer, decompile or derive the source code of any part of the Beta Website, integrate, copy, modify or create derivative works of any part of the Beta Website.

  11. You are responsible for:

    1. ensuring the accuracy, legality, appropriateness and ownership of all content and data you upload to the Beta Website;

    2. when sharing data with others, ensuring that you are sharing the correct data with the correct person and that you are happy to share the data with them. By choosing to share any data you represent that you are legally permitted to share that data; and

    3. ensuring any device you use to access the Beta Website is up to date and secure. We are not responsible for any issues that arise due to use by you of an insecure device.

  12. For more information about how we collect and use personal data please see our Privacy Policy. As set out in our privacy policy, we may share generic, anonymised and aggregated data or information about your eye health or which includes your eye health data to others so that they may research, create and market products and services. We will never use or share any data or information in a way that identifies you individually. 

  13. We may link to other websites. We are not responsible for these websites in any way, and do not endorse them. You should check their terms and conditions and privacy policy when you visit them. To the extent they provide medical information or advice you should not rely on this or take (or not take) any medical decision based on them. 

  14. All eye health information or guidance available on the Beta Website is provided on an information-only basis and is not intended to provide medical advice or to diagnose or treat any medical conditions. You should not rely on, or take (or not take) any medical decision based on any information on the Beta Website. You should always consult an appropriate healthcare professional (who is aware of and able to advise on your specific symptoms and/or health records) for advice on the diagnosis or treatment of any medical condition. 

  15. These Terms do not exclude our liability (if any) to you for personal injury or death resulting from our negligence, fraud, or any matter which it would be illegal for us to exclude by law. We are only liable to you for losses which you suffer as a direct result of our breach of these terms and conditions and which are reasonably foreseeable. We are not liable or responsible to you for any comments made by, or for any advice that may be given to you by, any eye care clinician by way of the Beta Website, as a result of your use of the Beta Website or otherwise.

  16. If you breach these Terms we may suspend or terminate your account. If we do so, you will no longer be able to access your account during the period of suspension or following the date of termination. 

  17. We will not be in breach of these Terms or liable for any failure or delay in performance of any obligations under these Terms as a result of any event outside of our control.

  18. You may not transfer any of your rights under these Terms to any other person.

  19. Only you and us have any rights under these Terms. No other person shall have any rights under these Terms.

  20. You may have other rights granted by law, and these Terms do not affect these except if the two are inconsistent. If this is the case then these Terms will override any other rights which you may have, unless this is not permitted by law.

  21. These Terms will be governed by English law and any court proceedings related to these Terms must be taken at a court within England and Wales, unless you live in Scotland or Northern Ireland, in which case you may bring court proceedings in Scotland or Northern Ireland.
